Invention And Patent Resources

Nanotechnology: big future from a small world.Patenting an idea can be a nightmare, a frustrating process, but worse of all, once patented, not reaching a market. This page is a collection of booklets and reports on the patenting process, patent filing, and how to avoid being ripped by unscrupulous service representatives.

Obtaining and protecting intellectual rights is not an easy task: 'the growing global trade in pirated and counterfeit goods threatens innovation, workers’ livelihoods, health, and safety.'

Protect Your Intellectual Property: Stop trade in fakes!

Intellectual property rights (IPR) encourage the innovation and creativity that is fundamental to sustained economic growth."The Strategy Targeting Organized Piracy (STOP!) is a comprehensive program to stop trade in pirated and counterfeit goods. Through STOP!, the U.S. government is working to make it easier for rights holders to obtain and enforce their intellectual property rights at home and abroad. The U.S. government has also leveraged its law enforcement resources and is establishing international cooperation to dismantle the criminal networks that manufacture and distribute fake goods."

International Patent Protection for Small Businesses

Recent economic research shows that small businesses are the primary driver of job creation in the United States."In an increasingly global economy, internationalization strategies can be effective mechanisms to access markets, serve unmet demand, and grow small companies, thereby increasing manufacturing, production, and job creation. Various ways of entering non-domestic markets—such as licensing, franchising, exporting, and foreign direct investment—have been shown to be related to the growth and successful performance of small companies."

Intellectual Property and Women Entrepreneurs

The number of patents granted to women is significantly higher than those reported in earlier studies."An analysis of the ratio of trademarks granted to trademark applications filed shows that it is increasingly more difficult to obtain a trademark from the USPTO. In 1985, 88.28% of all women applicants were successful in obtaining trademark protection. In 2010 it dropped to 49.6%."

General Information Concerning Patents

The Patent and Trademark Office (PTO) cannot respond to inquiries concerning the novelty and patentability of an invention."The United States Patent and Trademark Office (USPTO) registers both attorneys at law and persons who are not attorneys at law. The former persons are now referred to as ―patent attorneys‖ and the latter persons are referred to as ―patent agents.‖ Both patent attorneys and patent agents are permitted to prepare an application for a patent and conduct the prosecution in the USPTO. Patent agents, however, cannot conduct patent litigation in the courts or perform various services which the local jurisdiction considers as practicing law. For example, a patent agent could not draw up a contract relating to a patent, such as an assignment or a license, if the state in which he/she resides considers drafting contracts as practicing law."

A Guide To Filing A Design Patent Application

The Patent and Trademark Office cannot respond to inquiries about the patentability of an invention prior to filing."The preparation of a design patent application and the conducting of the proceedings in the USPTO to obtain the patent is an undertaking requiring the knowledge of patent law and rules and Patent and Trademark Office practice and procedures. A patent attorney or agent specially trained in this field is best able to secure the greatest patent protection to which applicant is entitled. It would be prudent to seek the services of a registered patent attorney or agent. Representation, however, is not required. A knowledgeable applicant may successfully prosecute his or her own application."

Basic Facts About Trademarks

Every application must include a clear image of the mark ('the drawing')."What is the difference between goods and services? Goods are products, such as bicycles or candles. Services are activities performed for the benefit of someone else, such as bicycle rental services or catering. The difference between goods and services may be confusing. Are your customers paying for a product or paying you to perform a specific activity? If your customer is paying you for a product, such as a candle or bicycle, then you have goods. However, if your customer is paying you to perform an activity, such as catering or bicycle rental, then you have services. You may list both goods and services in an application."

Inventions and Innovations

More than 500 inventions have received financial support from DOE, with nearly 25% reaching the marketplace."Are you an individual inventor or small business planning to develop your energy-saving invention or innovation? Have you been searching for financial and technical support to bring your idea to market? The U.S. Department of Energy’s (DOE) Inventions and Innovation (I&I) Program can help."

What's the Deal With Copyright and 3D Printing?

Trademarks, copyright, patent, and the three primary types of intellectual property."In the United States, copyright and patent rights can both be traced to the Constitution and are designed to encourage the creation and dissemination of creativity and knowledge. The rights are related but do not overlap: copyright and patent are mutually exclusive6 and their types of coverage are different in important ways. Copyright covers artistic, creative works. Essentially, copyright covers the types of things that you would look to an artist to produce: paintings, movies, novels, and sculptures."

Technological Innovations In Transportation For People With Disabilities

There are several systems designed to help overcome the barriers faced by people with visual impairments in getting around in day-to-day life."One useful tool to aid a visually impaired person getting around is RIAS, a system that labels the environment so people who cannot read printed signs still have access to that information. A receiver on the unit converts a transmitted infrared signal into a voice message.

A user can scan the area for infrared transmitter labeling on many things, including bus stops, ticket machines, boarding areas, restrooms, elevators, and stairs. Its other functionality includes detecting and providing information on wait times, destination information, and pedestrian crossings. The directional system means that as a user walks in the direction of a particular sign, the message becomes clearer and louder—RIAS only detects the strongest signal a user is pointing towards."

Empowering The Nation Through Discovery And Innovation: NSF Strategic Plan For Fiscal Years (FY) 2011-2016

NSF-supported research crosses disciplinary boundaries."Transforming the frontiers requires scientists and engineers who are trained and motivated to tackle the difficult challenges of working in uncharted territory. Throughout our history, NSF has been the agency charged with ensuring the nation’s capacity to generate the workforce needed to meet these challenges. NSF’s primary approach to addressing this performance goal is the integration of research and education. Thus, the development of talented young people includes connection to the frontiers of knowledge and direct experience in the conduct of research in the U.S. and in other countries. The Foundation promotes inquiry-based instructional practices and ongoing research on the process of learning and the practice of education to improve the nation’s capacity to draw in and retain students in STEM fields, including students from underrepresented groups and institutions."

The Rise Of The Flash Memory Market: Its Impact on Firm Behavior and Global Semiconductor Trade Patterns

Semiconductor producers have devised various strategies to meet the increased demand for flash memory and obtain market share."Corporate and military demand were the primary market drivers of the semiconductor industry then, and historically in the United States these and other sources had always accounted for a much greater share of semiconductor end-use demand than the consumer market. However, since 1993 the consumer electronics market has increased its share of the overall semiconductor market, leading one market research firm to predict that by 2013, consumer markets will account for more than 50 percent of the overall semiconductor market, roughly a 30 percent increase in the share of the semiconductor market in 20 years."

Invention Promotion Firms

Unscrupulous invention promotion firms tell all inventors that their ideas are among the relative few that have market potential."Unscrupulous firms often promise that they will exhibit your idea at trade shows, but don’t actually go to these trade shows, much less market your idea effectively. Check with previous clients and trade show sponsors about whether their ideas were exhibited.

Many unscrupulous firms agree in their contracts to identify manufacturers by coding your idea with the U.S. Bureau of Standard Industrial Code (SIC). Lists of manufacturers that come from classifying your idea with the SIC usually are of limited value."
